BETH TZEDEC CONGREGATION - UPDATE TO BY-LAWS (MAY 25, 2021)
Background
At the May 25, 2021 Annual Meeting, a by-law amendment was introduced and voted favorably upon to address the circumstances where disciplinary actions may be considered for a violation of congregational policies. For context, although the Board of Directors had previously approved a Harassment Policy indicating that the consequences of a breach may be termination of membership, the by-laws as they were originally written would not allow for that to occur because they were not specifically noted in the by-laws.
The amendment was to Section 8.03:
ORIGINAL: 8.03 (1) Disciplinary Act or Termination of Membership for Cause
Upon fifteen (15) days' written notice to a Member, the Board may pass a resolution authorizing disciplinary action or the termination of membership for violating any provision of the Articles or By-laws.
NEW: 8.03 Disciplinary Act or Termination of Membership for Cause
(1) Upon fifteen (15) days' written notice to a Member, the Board may pass a resolution authorizing disciplinary action or the termination of membership for violating any provision of the Articles or By-laws or for violating any policy of the Congregation provided that the Board determines by resolution that violation of such policy shall be grounds for disciplinary action or termination of membership and provided further that the policy shall be published on the Beth Tzedec website or otherwise communicated to the membership together with a statement to the Members that the breach thereof may be grounds for disciplinary action or termination of membership
(2)The notice shall set out the reasons for the disciplinary action or termination of membership. The Member receiving the notice shall be entitled to give the Board a written submission opposing the disciplinary action or termination not less than 5 days before the end of the 15-day period. The Board shall consider the written submission of the Member before making a final decision regarding disciplinary action or termination of membership.

The motion to approve the amendment to Section 8.03 was passed at the Annual Meeting on May 25, 2021.
